Tax Residency Apostille

Do you require an apostille on a Tax Residency Certificate?

United States treaty partners require the IRS to verify for federal tax purposes that a company or an individual claiming treaty benefits is a legal resident of United States. The IRS issues this residency certification on Form 6166 which is commonly referred to as U.S. Residency Certification.

Form 6166 is a letter printed on U.S. Department of Treasury stationery and confirming that the individuals or legal entities listed in this form are residents of United States for purposes of the income tax laws of the United States. Form 6166 may be used to claim income tax treaty benefits and certain other tax benefits in foreign countries.
 
If you plan to work or teach in a foreign country that has signed a tax treaty with the United States, there may be a legal way for you to avoid being taxed twice.  We advise that you contact the IRS and inquire if the country of your destination has a tax treaty with the United States.

If your business is involved in international transactions, it may be beneficial for you to establish representative offices in countries where you conduct your business. If those countries have signed tax treaties with the United States, you will qualify got the reduced tax rates if you prove to the government of that country that you are a resident in the United States. Form 6166 is also required to claim exemption from a VAT (Value Added Tax) imposed by a foreign country.

International tax treaties permit residents of foreign countries to pay reduced taxes. Tax treaties help prevent double taxation or allow reduced rates in taxes owed.

To receive an apostille on Form 6166 you should first obtain this form by completing Form 8802. The IRS typically sends out this form within a few weeks. Once you receive Form 6166 printed on the Department of Treasury stationery, you will need to mail it to our office for apostille processing via the US Department of State.
