Why do I need a Certified Divorce Decree Apostille?
If you have previously been married and want to enter a new marriage in a foreign country, you will be required to provide an apostilled Certified Divorce Decree.
How can I apostille a Divorce Decree?
An original or a certified copy issued by the Family Court (in some states also called Superior Court, Circuit Court, or County Court) is required to obtain an apostille on a Divorce Decree. If you don’t have an original or a certified copy of your Divorce Decree, you can request one from the Court directly. If you used an attorney to settle your divorce, your attorney may have a certified copy of your divorce decree on file, otherwise, he/she can request an original or a certified copy from the Court on your behalf.
Apostille on a Divorce Decree is always processed by the same state which issued the document. For example, if your divorce was settled in Florida and a divorce decree was issued by the state of Florida, an apostille on your document will also be processed by the State of Florida. Some states have limitations on a “shelf life” of a divorce decree. A majority of states will apostille divorce decrees regardless of the date of their issue. Some states, however, require that a divorce decree was issued less than five years ago, and a few have even shorter “shelf life” requirements. Virginia and Wisconsin, for example, can only process apostille on a Divorce Decree issued 12 months ago or less.
